Complaint Filed in U.S. District Court Following Opensea Hack

McKimmy v. Opensea

In the latest legal battle over digital assets, the owner of a stolen non-fungible token (NFT) is suing the crypto marketplace where it was listed for sale.

Plaintiff Timothy McKimmy was the original owner of a particularly valuable “Bored Ape” NFT. The NFT in this case had a rarity score of 138.52 and a rarity rank of #1392/10,000, which is considered to be in the top 14% of the collection.

The owner alleged in his complaint that Opensea was negligent in its security measures and breached its fiduciary duty to McKimmy. (Full Complaint)
